COPYRIGHT & USAGE RIGHTS
PRIME SHOT MEDIA
Website: https://theprimeshotmedia.com
This Copyright & Usage Rights Policy explains the ownership, permitted use, licensing, delivery, and protection of photographs, videos, films, and other creative materials produced or supplied by PRIME SHOT MEDIA ("we," "our," "us," or the "Company"). It applies to our photography, videography, event coverage, commercial production, social media content, and related creative services, together with the relevant quotation, contract, or project agreement.
1. Copyright Ownership
Unless otherwise expressly agreed in a written contract or required by applicable law, copyright and other intellectual property rights in original photographs, video footage, films, edits, graphics, and other creative materials produced by PRIME SHOT MEDIA remain with the relevant rights holder as determined under applicable law.
Payment for a photography, videography, or production service does not automatically transfer copyright or grant unrestricted ownership of all original files, footage, project files, or creative assets to the client.
Any transfer or assignment of copyright must be expressly agreed in writing and is subject to applicable law.
2. Client Usage Licence
Once the agreed payment has been received in full, PRIME SHOT MEDIA grants the client the usage rights specified in the accepted quotation, contract, invoice terms, or separate written licence.
Unless the project agreement states otherwise, the client's licence is limited to the final deliverables supplied for the agreed project and the intended business or personal purpose communicated at the time of booking.
Permitted uses may include personal sharing, company websites, social media accounts, marketing campaigns, and other agreed promotional activities, subject to the scope of the licence and any third-party rights or restrictions.
3. Commercial and Advertising Usage
Commercial use of photographs, videos, and other deliverables must remain within the usage scope agreed for the project.
Where applicable, paid advertising, television commercials, outdoor advertising, product packaging, resale, sublicensing, distribution to third parties, use in large-scale campaigns, or use in additional markets may require a separate licence or written approval.
Any additional usage fees, duration limits, geographic restrictions, platform restrictions, or exclusivity arrangements must be agreed in writing before the relevant use begins.
4. RAW Files and Source Materials
RAW photographs, unedited video footage, audio recordings, editing timelines, project files, presets, working files, and other source materials are not included in the standard delivery unless expressly stated in the accepted quotation or written agreement.
Where source materials are included as an agreed deliverable, the client receives only the rights expressly granted in writing. The delivery of source materials does not, by itself, transfer copyright or ownership of underlying creative assets.
5. Editing, Alteration and Redistribution
Clients may resize, crop, or adapt delivered materials for the licensed purpose where permitted by the project agreement and applicable law.
Unless expressly authorised in writing, clients must not sell, resell, sublicense, redistribute, or make the materials available as standalone stock content or reusable creative assets.
Clients must not remove copyright notices or creator credits where their retention is contractually required or legally protected. Any material alteration that misrepresents the work or infringes applicable rights may be restricted by law.
6. Portfolio and Promotional Rights
PRIME SHOT MEDIA values client privacy and confidentiality. We will not assume that permission to create photographs or videos automatically authorises their use in our portfolio or promotional materials.
We may display client photographs, films, or project extracts on our website, social media, showreels, case studies, presentations, or other marketing channels only where we have obtained any necessary permission or the use is otherwise legally authorised.
Where a client has agreed to confidentiality or restricted-use terms, those terms will be respected in accordance with the relevant agreement and applicable law.
Clients who require confidential production, embargoed publication, or a prohibition on promotional use should notify us before the project begins and obtain written confirmation of the agreed restrictions.
7. Client-Supplied Content
Clients are responsible for ensuring that they have the necessary rights, permissions, licences, and authorisations for any logos, photographs, videos, music, artwork, scripts, trademarks, documents, or other materials they supply for a project.
Clients authorise PRIME SHOT MEDIA to use such materials only as reasonably necessary to perform the agreed services, subject to the project agreement and applicable law.
We may decline to use material where there is a reasonable concern that its use could infringe third-party rights or violate applicable law.
8. Music, Fonts, Stock Assets and Third-Party Rights
Projects may incorporate music, fonts, stock footage, graphics, software, templates, or other assets licensed from third parties. These assets remain subject to their respective licence terms.
A client's permission to use a final video does not necessarily include independent rights to reuse its music, stock assets, or other third-party elements outside that video or beyond the applicable licence.
Clients are responsible for obtaining any additional permissions required for uses beyond the licence supplied with the deliverables. PRIME SHOT MEDIA will communicate known material restrictions where reasonably practicable.
9. Social Media Platforms
When content is published on platforms such as Instagram, Facebook, TikTok, YouTube, LinkedIn, or other services, the content may also be subject to the platform's terms, music policies, advertising rules, and content requirements.
Clients are responsible for ensuring that their intended publication and advertising use complies with the applicable platform rules and the usage licence granted for the project.
10. Delivery, Storage and Archiving
Final deliverables will be provided in the formats and through the delivery method agreed in the quotation or project agreement.
Unless a different period is expressly agreed in writing, clients should download and securely back up their delivered files promptly. PRIME SHOT MEDIA does not guarantee indefinite storage or permanent availability of project files, source footage, or download links.
Any post-delivery storage, retrieval, restoration, or re-delivery service may be subject to availability and additional charges agreed with the client.
11. Copyright Infringement and Unauthorised Use
Unauthorised copying, commercial exploitation, redistribution, or other use of protected materials outside the applicable licence may infringe intellectual property rights.
Where legally appropriate, PRIME SHOT MEDIA or the relevant rights holder may request removal of unauthorised content or pursue remedies available under applicable law.
Nothing in this Policy limits any rights or remedies available to clients, creators, or third-party rights holders under applicable law.
12. Exclusive Rights and Copyright Transfer
Any exclusive licence, copyright assignment, work-for-hire arrangement where legally recognised, or transfer of intellectual property rights must be clearly documented in a separate written agreement or an expressly applicable contract clause.
The agreement should specify the relevant materials, rights transferred, permitted uses, territory, duration, exclusivity, fees, and any retained rights. Unless such terms are agreed in writing, no broader transfer should be assumed.
13. Disputes and Applicable Law
This Policy is intended to operate in accordance with the applicable laws and regulations of the United Arab Emirates, including applicable intellectual property and copyright legislation.
If any provision of this Policy conflicts with mandatory applicable law or a binding written agreement, the relevant law or agreement will prevail to the extent of the conflict.
14. Policy Updates
PRIME SHOT MEDIA may update this Policy from time to time. The terms applicable to a particular project will be determined by the relevant accepted agreement and applicable law. Updated versions will be published on this page with a revised effective date.
